IMPORTANT SHIPPING INFORMATION


An FFL license copy from your dealer is required to ship your order.

To insure a smooth and fast buying experience please note these important instructions:​​

In order to ship a firearm, we must send it to the licensed dealer of your choice and it is the buyer’s responsibility to locate a dealer where they live to accept the transfer. Most dealers offer this service.

Be sure the item is legal to own in your state. We do not ship any item that, as configured directly from the factory, is unlawful to own in your state. There are no exceptions.

We must have a copy of the dealer’s license (FFL License Copy) before we can ship to them.

It is the buyer’s responsibility to contact their licensed dealer and have them send us a copy of their license. We do not contact the dealers on behalf of the buyer. Your FFL dealer can email us a copy of their license or they can mail it to us.

If you are sending a USPS money order or bank certified check for payment, it is easier for us if you send the dealer’s license (FFL copy) with your payment.

You can let your dealer know that we automatically include a copy of our FFL license with the firearm.

In all instances, we require your dealer to include the order number and your full name with the license (FFL Copy) so we know what order the license pertains to.

​​Shipping Insurance:
Shipping insurance is optional at checkout. If a buyer (you) DOES NOT select shipping insurance at checkout, the buyer (you) are acknowledging that any item(s) purchased become(s) the buyer's (your) property immediately upon acceptance by the shipping company and, at that point, Red Circle Tactical is released from any responsibility for the buyers (your) item(s). If this policy in unacceptable, the buyer (you) must select and purchase insurance at checkout.

Shipping Times:
We ship fast, but due to order volume, orders can take up to 14 business days to ship or be ready for local pickup. 
If we are shipping your order, remember that we cannot ship your firearms until we have received your FFL dealer's FFL license copy.

IMPORTANT PRICING INFORMATION

​​Online Store vs Retail Store:
Our online prices are competitive with other online sellers and are set as low as we can go and everybody gets our lowest possible price at all times. As such, we do not offer price matching nor have any military or police discount (stores that offer this type of discount set their prices higher so that they can give you this 'fake' discount).

Our retail location prices may vary from our online prices and the best price will always be at our online store.

Not all the inventory you see listed for sale at our online store is available at our retail location. If you are local and desire an item, the best way to guarantee your item is to buy it at our online store, choose in store pickup and we will advise you when it is ready for pickup.


STORE POLICIES

It is the customer's responsibility to read all Red Circle Tactical's Policies prior to purchase.

Returns: 
​This return policy supersedes all other policies.

All sales are final. All firearm sales are final. No refunds or returns.  Exception is, of course, made for any error on our part.

Be sure the item you want to purchase is the item you want and, most importantly, legal in your state and you are legally allowed to own it as all sales are final. Check with local law enforcement in your area if you are not sure before buying. We are happy to help with pre-purchase sales advice and we will do our best to help you. If you are unsure about legality we will also help as best was we can, but ultimately it is your responsibility to determine legality in your state. State laws can change very quickly and sometimes without notice.

All new firearms carry the full manufacturer warranty and we are authorized resellers for the brands we carry.  In the unlikely event a new-in-box firearm requires repair, most manufacturers are eager to help you arrange for repair. Please contact them first. If you have any issues with them please contact us and we will help. Legally, you can send a firearm to the manufacturer for repair and they can legally return that firearm directly to you once repaired.

Used guns are sold as is. No refunds or returns. All used firearms should be checked by a qualified gunsmith prior to firing.  

Product Availability: 
All our products are in stock at either our physical store, at our warehouse or at one of our distributors. Keep in mind that in some rare instances, an item you ordered may be out of stock for various reasons beyond our control. We will advise you as soon as we realize there is an issue. 

*Due to order volume, in-store pickup and order shipments may be delayed up to 15 days.

Price and description errors:
Due to order volume, our online inventory changes constantly. 

Occasionally, an item may appear on the site by mistake or the item's description may contain a typographical error. We do not guarantee that titles, descriptions, pictures or prices on our site are error-free. Please verify any item you are interested in purchasing prior to purchase especially if you are unsure. 

We reserve the right to refuse any order including but not limited to orders for items with errors in the description or price.  

In the event that we cancel an order we will not charge the customer's credit card, or we will refund/reverse the charge.

If an item's description contains an error such as incorrect photo, price, accessory or description and a customer makes the order, we will not process the order without first contacting the customer. If the order is mistakenly shipped, we may advise the customer to return the item in its original and unopened condition and we will refund the customer. 

Any order cancellation is subject to a 20% restocking fee with a $20 minimum. Additionally, payment processing fees will be deducted from your refund as payment processors no longer refund those charges to merchants. Any return due to our error, must be received within 30 days from the date of purchase to be considered for a refund.  We will be responsible for return shipping charges on any order error on our part. Any shipment that is refused is subject to a 50% restocking fee and loss of all shipping costs.

By placing an order, the customer agrees that Red Circle Tactical will be the final arbiter of any discrepancies.

LEGAL DISCLAIMERS & STORAGE FEES

LEGAL DISCLAIMER:

​By making a purchase from Red Circle Tactical the buyer agrees to have any firearm purchased checked by a certified gunsmith prior to use. It is the purchaser's responsibility to verify that any firearm(s) purchased is/are safe to operate. As Red Circle Tactical has no means of testing firearms, Red Circle Tactical assumes no liability for the safe functioning of any firearm sold. Buyer agrees that all firearms are potentially dangerous, especially if handled improperly. Buyer assumes all liability and responsibility for the condition, use, security and storage of any firearm purchased.

Buyer agrees that purchasing a firearm from Red Circle Tactical that he or she is legally qualified to purchase and own a firearm and that there are no state or local laws preventing ownership and the buyer will utilize a trigger lock to prevent accidents. Buyer must be at least 18 years old to purchase long guns and at least 21 years old to purchase handguns as well as a legal resident of the United States.


The Buyer certifies that he/she is not restricted or forbidden by law to own a firearm and hereby unequivocally states that he/she:
  • is of LEGAL AGE to own the firearm(s), or ammunition, which they are purchasing.
  • is purchasing the firearm(s) for their personal ownership and NOT making a purchase / transfer on behalf of someone else.
  • CAN lawfully receive, possess, ship, or transport a firearm.
  • has NEVER been convicted in any court of a crime punishable by imprisonment for a term exceeding one year.
  • is NOT a person who is under indictment for a crime punishable by imprisonment for a term exceeding one year.
  • is NOT a fugitive from justice.
  • is NOT an unlawful user of or addicted to any controlled substance (this includes Marijuana / Cannabis).
  • has NEVER been adjudicated as a mental defective or has been committed to a mental institution.
  • is NOT an alien illegally or unlawfully in the United States, or an alien admitted to the United States under a non-immigrant visa.
  • has NOT been discharged from the Armed Forces under dishonorable conditions.
  • If a citizen of the United States, has NEVER renounced his or her citizenship.
  • is NOT subject to a court order that restrains them from harassing, stalking, or threatening another.
  • has NOT been convicted in any court of a misdemeanor crime of domestic violence.
  • agree that you do not intend to purchase or acquire any firearm or ammunition, for sale or other disposition to a disqualified person that does not fall within a nonimmigrant alien exception.
  • agree that you do not intend to sell or otherwise dispose of any firearm purchased or ammunition in furtherance of any felony or other offense punishable by imprisonment for a term of more than one year, a Federal crime of terrorism, or a drug trafficking offense.
  • acknowledges that NO warranty is offered by the seller for the firearm(s) or ammunition, beyond the manufacturer's warranty.
  • agree that by making a purchase you agree to and acknowledge all of Red Circle Tactical's policies for purchase / transfer. This applies to any of our sales venues and not limited to, but including our retail store front, our website, Guns America and Gunbroker. This agreement covers all subsequent purchases made at any of our venues.
  • acknowledges that ALL ammunition and firearms purchases are FINAL and non-returnable.
  • acknowledges that we cannot evaluate the validity of Trust or Corporation documents; all transfers to a Trust or Corporation must be completed, in-person, by the original purchaser.

INDEMNIFICATION AND AGREEMENT TO DEFEND
I fully and expressly agree that if any of my representations when making purchases under the Terms of Sale are incorrect or if I fail to comply with these Terms of Sale, then I will indemnify, defend, save harmless, and release Red Circle Tactical and its owners, agents, officers, and employees against any civil liability or criminal prosecution resulting from my purchase from Red Circle Tactical.

I fully and expressly agree that by placing my order, I release Red Circle Tactical from any and all liability arising from or related to the products I purchased from Red Circle Tactical, including (but not limited to) my or anyone else use of the product, my or anyone else’s storage of the product, and my or anyone else’s handling or transportation of the product, and I agree to indemnify, defend, save harmless, and release Red Circle Tactical and its owners, agents, officers, and employees against any civil liability or criminal prosecution resulting from the products I purchased from Red Circle Tactical. 

Upon purchase, buyer assumes all liability and responsibility including but not limited to the usage and storage of the purchased firearm as well as responsibility to read and understand the firearms owner's manual. Purchaser releases Red Circle Tactical and its officers from any and all liability associated with purchasing, use, and storage of the item(s) purchased from Red Circle Tactical.


CLASS ACTION WAIVER
You expressly and fully agree that any dispute resolution proceedings, including but not limited to, litigation, arbitration, and mediation, will be conducted only on an individual basis and not in a class, consolidated, or representative action. By making this express agreement, you acknowledge and affirm that this is a knowing, voluntary, and permanent waiver of any right to bring federal, state, or local claims as any part of, or on behalf of, any class or any other individuals, before a court or other tribunal.


TRADEMARKS
Red Circle Tactical and other marks indicated on our site are trademarks owned exclusively by Red Circle Tactical or the respective brand. The use of these trademarks and trade dress is prohibited if used in connection with the sale of any product that is not Red Circle Tactical or any other trademarked brand, in any manner that seeks to disparages or discredit Red Circle Tactical or in any manner that may cause confusion among our customers.


COPYRIGHT
All content on this website is the exclusive property of Red Circle Tactical. Said content includes text, graphics, logos, icons, images, audio and video clips, digital downloads, and software. Our content is protected by United States and international copyright laws and we reserve all rights contained therein. In case of dispute or infringement, we will rigorously defend our rights to this material.


DISCLOSURE
We may disclose your personal information if we are required by law to do so, or if you violate our Terms of Service.


STORAGE FEES:

Effective 11/01/2014:

Firearms such as handguns, rifles and receivers that are unclaimed/not transferred after 30 days are subject to a daily storage fee of $25.

NFA items such as Silencers, Short Barreled Rifles, Short Barreled Shotguns and AOWs that are held for more than 30 days without BATFE transfer paperwork submitted, are subject to a daily storage fee of $50. BATFE approved items must be picked up ASAP. Any of these approved items held more than 10 days is/are subject to the $50 daily storage fee.

NFA Machine Guns (MG) that are held for more than 30 days without BATFE transfer paperwork submitted, are subject to a daily storage fee of $250. BATFE approved items must be picked up ASAP. Any approved MG held more than 10 days is subject to the $250 daily storage fee.

Obviously there are circumstances in which we can make an exception to these rules, but you must contact us to discuss as soon as you know there will be a delay. 

Any item left over 90 days is subject to sale or surrender to the State Police.


FBI NICS BACKGROUND CHECK:

Due to new FBI NICS background check requirements effective Nov 2022, due to the passing of 'the Bipartisan Safer Communities Act (BSCA) of 2022', for purchases by those under the age of 21, we no longer sell firearms to anyone under the age of 21.

FBI NICS Delay:

If you buy a firearm(s) from Red Circle Tactical and during the FBI NICS background check (at our retail store) you are given a response of 'Delay', the Brady Act allows a gun dealer to transfer your firearm(s) to you after 3 of their business days (BTW This is optional). 

If after 3 business days, the FBI still has not made a determination on your background check, our store policy is to give the FBI a full 15 business days to work on your background check.

Most of the time, the FBI NICS section provides results in less than 3 days, but longer delays do occur on occasion. It's our sincere goal to get you your firearm as quickly as possible and in congruence with all BATFE rules and regulations. The extra wait time helps to avoid the hassle of a visit by the ATF to your home, in case the ultimate result is a denial and you have already taken possession of your firearm(s).

If the result of the FBI NICS background check is any response other than 'proceed' (but not denial), it is our policy that we will not transfer a firearm until the FBI provides a 'proceed' response. By law, the FBI has up to 89 days to complete the background check. However, after 30 days the check expires and has to be run again as a new check. Thus, if after 29 days have passed, and the FBI has not provided a response of 'proceed', we will be required to void the sale and process a refund under the terms of our current refund policies.


FBI NICS DENIAL

If you buy a firearm(s) from Red Circle Tactical and during the FBI NICS background check (at your dealer or our retail store) you are given a response of 'denial', you cannot legally take possession of the firearm(s).

In all instances you cannot have a friend, relative or any other person transfer that firearm(s) on your behalf and then deliver it to you. This is unlawful.

There are NO REFUNDS OR RETURNS due to a NICS DENIAL response. Additionally, If you are DENIED, and you purchased your firearm(s) out of state and we are acting as a transfer agent, you must contact that dealer to make arrangements for a return or some other solution with them.
